Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of Zephy ("Zephy", "the Application", "the Service", "we", "us" or "our"), a flight companion application for paramotor, powered paraglider (PPG) and paraglider pilots.

By downloading, accessing or using Zephy, you agree to be bound by these Terms. Please read them carefully, together with our Privacy Policy and Data Deletion Policy, which form part of your agreement with us.

1. Acceptance of Terms

By using Zephy, you confirm that you have read, understood and agree to these Terms. If you do not agree with any part of these Terms, you must stop using the Application.

Your continued use of the Service after any update to these Terms constitutes your acceptance of the revised Terms.

2. Eligibility

To use Zephy, you must have the legal capacity to enter into a binding agreement in your jurisdiction.

Minors may use the Application only in accordance with applicable law and, where required, with the consent and supervision of a parent or legal guardian. By using Zephy, you represent that you meet these requirements.

3. Description of Services

Zephy provides tools designed to support pilots before, during and after their flights. Depending on your device and the version of the Application, features may include:

• Flight tracking;
• Flight logging;
• GPS recording;
• Weather information;
• Flight statistics;
• 3D Replay;
• Social sharing;
• Cloud synchronization;
• User profile;
• Authentication services;
• Artificial intelligence-assisted features (where available).

We may add, modify or remove features at any time to improve the Service.

4. User Accounts

You may access Zephy using one of the following sign-in methods:

• Google Login;
• Apple Login;
• Facebook Login.

You are responsible for maintaining the security of your account. You agree to:

• Keep your account credentials confidential and not share them with others;
• Take reasonable steps to protect access to your device and account;
• Notify us immediately of any unauthorized use of your account or any other security breach.

You are responsible for all activity that occurs under your account.

5. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

• Violate any applicable law or regulation;
• Provide false, misleading or fraudulent information;
• Attempt to gain unauthorized access to our servers, systems or networks;
• Reverse engineer, decompile or disassemble any part of the Application, except where permitted by law;
• Upload, transmit or distribute malware or malicious code;
• Interfere with or disrupt the operation of the Application;
• Use unauthorized automation, bots or scraping tools;
• Attempt to compromise the security or integrity of the Service.

6. Flight Safety Disclaimer

Zephy is a support tool only. It is designed to assist pilots, but it does not replace:

• Proper flight training;
• Pilot judgment and decision-making;
• Certified equipment;
• Certified aeronautical instruments;
• Professional meteorological analysis.

All flight decisions remain the sole responsibility of the pilot.

7. Weather Information Disclaimer

Weather information within Zephy is provided by third-party services. While we make reasonable efforts to present up-to-date data, we do not guarantee its absolute accuracy, completeness or timeliness.

You are solely responsible for verifying weather conditions through reliable and official sources before every flight.

8. 3D Replay Disclaimer

The 3D Replay feature is provided for recreational and analytical purposes. Differences may exist between a replay and the actual flight due to factors such as:

• GPS accuracy;
• Recording frequency;
• Data interpolation;
• Device limitations.

Replays should not be treated as a precise or certified record of a flight.

9. User-Generated Content

When you create or share content through Zephy — such as images, videos, replays, statistics or comments — you retain ownership of that content.

By using the Service, you grant Zephy only the limited permissions necessary to store, process and display your content so that the Application's features can function as intended. We do not claim ownership of your content.

10. Social Sharing

Sharing content to platforms such as Facebook and Instagram occurs only through your explicit action. Zephy never publishes anything automatically or without your consent.

When you share content to a third-party platform, that platform's own terms and privacy policy govern the content once it leaves the Application.

11. Third-Party Services

Zephy relies on external services to provide certain features, including:

• Google Sign-In;
• Apple Sign-In;
• Facebook Login;
• Firebase;
• Open-Meteo;
• Map providers.

Each third-party service is governed by its own Terms of Use and Privacy Policy. We encourage you to review them. We are not responsible for the practices, availability or content of third-party services.

12. Intellectual Property

All software, source code, visual identity, logos, interface, design and the Zephy brand are the property of their respective owners and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify or create derivative works from any part of the Application without prior written authorization.

13. Availability

The Application may be subject to maintenance, updates and temporary unavailability. We do not guarantee that the Service will be available at all times or free of interruptions or errors.

We may modify, suspend or discontinue any part of the Service at any time without liability to you.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Zephy shall not be liable for any:

• Accidents;
• Losses;
• Damages;
• Injuries;
• Financial losses;
• Decisions made before, during or after flights.

The Application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. The pilot is fully and solely responsible for their operation, conduct and safety.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the LGPD and GDPR where relevant.

15. No Aviation Certification

Zephy is not certified aviation equipment. It does not replace:

• Homologated or certified instruments;
• Mandatory equipment required for flight;
• Certified devices for air navigation.

You must not rely on Zephy as a substitute for certified aviation instruments or required safety equipment.

16. Termination

You may stop using the Service and close your account at any time. Information on deleting your account and data is available in our Data Deletion Policy.

We may suspend or terminate your access to the Service, without prior notice, in cases of:

• Fraud;
• Abuse;
• Violation of these Terms.

17. Privacy

Your use of the Service is also governed by our privacy documentation, which explains how we collect, use and protect your data, and how you can request its deletion:

18. Governing Law

These Terms shall be interpreted and governed in accordance with the applicable laws of the jurisdiction in which the Service is operated, without regard to conflict-of-law principles. Where mandatory consumer or data protection laws apply to you, nothing in these Terms limits the rights granted to you under those laws.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date shown on this page. Material changes may be communicated through the Application or by other reasonable means.

You are advised to review these Terms periodically. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
